The rise of generative AI has led to a wave of lawsuits filed by content owners and copyright holders against technology companies, alleging that these companies are using their copyrighted works as data to train AI systems without permission.

Claims in LawsuitsFor the creative community, one of the biggest frustrations with generative AI is the source of AI training data. All of the lawsuits from content owners primarily frame their complaints as copyright infringement. Some cases have also claimed unfair competition, unjust enrichment, trademark dilution, and commercial misappropriation, among other complaints.

AI developers, meanwhile, often believe that training based on copyrighted work qualifies as fair use, the exception under U.S. copyright law that allows certain uses of copyrighted material without permission.
